We have a quick policy update for our Midwest customers: Missouri is officially taking steps to comply with recent federal law that removes unlawful synthetically derived intoxicating hemp products from shelves, closing a legal loophole in the unregulated hemp market.
On Thursday, April 23, Missouri Governor Mike Kehoe signed HB 2641 — the Intoxicating Cannabinoid Control Act (ICCA) — into law.
It’s generated a lot of conversation in our world, so here’s what it means for you as a Key Cannabis customer.
What is the ICCA?
For years, intoxicating hemp-derived products like Delta-8, Delta-10, HHC, and THCP have been sold in gas stations, smoke shops, and online retailers, outside the licensed cannabis system and without the safety testing that regulated operators follow.
The ICCA brings Missouri law into alignment with federal law banning the sales of synthetically derived intoxicating products, and gives law enforcement, prosecutors, and the Attorney General the tools to enforce it.
While the sale of synthetically derived intoxicating cannabinoids is prohibited, naturally occurring intoxicating cannabinoids will continue to be sold in licensed dispensaries. The law is set to go into effect in November 2026, at the same time as the federal law.
What does ICCA mean for Key Cannabis?
Nothing changes for us, or you. We’ve always operated as a fully licensed, state-regulated cannabis company in Missouri, Illinois, and Arizona. That means:
- Every product we sell undergoes state-mandated testing for potency, purity, contaminants, heavy metals, and residual solvents.
- Our products are traceable from seed to sale, with strict labeling and compliance requirements.
- We don’t sell hemp-derived or synthetically converted cannabinoids. Our flower, vapes, edibles, and concentrates come from regulated cannabis.
The ICCA will only affect businesses unlawfully selling intoxicating cannabinoid products outside the licensed system.
