Smoke shops and licensed cannabis dispensaries look the same from the outside (green cross, neon signs shaped like a weed leaf, fun weed puns), but in Missouri, they operate with very different rules, and actually sell different products.

• Missouri’s cracking down on sales of cannabis products sold in unregulated retailers (smoke shops, THCA shops*, CBD stores, and gas stations) this November. 
• Illinois passed the Illinois Hemp Act to halt the sale of intoxicating hemp products to anyone under the age of 21 and will follow suit with the federal government on reclassification for hemp-derived cannabinoids.
• Arizona faces ongoing challenges with enforcement of laws to restrict the sales of intoxicating hemp-derived products due to a lack of resources.

Dispensary vs. Smoke Shop: The Basics

In Missouri, when you shop at a licensed cannabis dispensary, you’re buying Delta-9 cannabis that’s legally grown, processed, tested, and sold within the state’s regulated system.

A smoke shop or CBD store may sell hemp-derived products like Delta-8 THC or high-THCA products. It may look and smell like traditional cannabis, but, because they’re derived from the same plant, they can be sold outside of Missouri’s licensed, legal cannabis system (thanks to a legal loophole the federal government is in the process of closing). So they aren’t subject to the same mandatory testing, labeling, and safety requirements.

Some smoke shops or CBD stores may be selling Delta-9 THC, but it may be shipped in from another state like California or Colorado. Because there is no seed to sale tracking on products shipped in from out of state, there is no guarantee on its dosing consistency, safety, or ability to trace back to a recall. 

Dispensary vs. Smoke Shop: Shopping Experience

Dispensaries and smoke shops also have different shopping experiences and conveniences. 

At a smoke shop or CBD store, you can walk in and pick up products off the shelf. 

Licensed dispensaries offer more shopping options. The lesser-known fact is why, and what that gets you:

Consistency: Every product sold at a licensed, regulated Missouri dispensary was grown and produced in the state (not necessarily the case with unregulated product). Because of the strict testing rules, the dosing of a product is consistent and accurately labeled. 

Safety: All regulated products are rigorously tested for quality and safety. Flower and pre-rolls, for example, have to pass through one of ten state-certified labs, checked for pesticides, heavy metals, mold and moisture, microbial impurities, and more before they’re legally allowed on a shelf.

Unregulated products at THCA or smoke shops contain unknown additives or contaminants, and there is no required testing to verify its contents.

It’s traceable. Every legal product is tracked from seed to sale. If there’s ever a call for concern, there’s a record and a system in place to remove the product from shelves, if needed. 

Childproofing. Licensed cannabis products have to meet state requirements designed to keep them out of the hands of kids, including child-resistant packaging and restrictions around how products can be presented. Unregulated products don’t have these same restrictions and have been found to mimic candy brands on many occasions.
